In order to maintain and enhance our Votyv marketplace platform, which includes our website (votyv.com) and all the services we provide (collectively referred to as our "Site"), we, Guidon Group LLC doing business as Votyv ("Votyv," "we," "us," or "our"), gather information from you.

This Privacy Policy covers information about how we at Votyv gather, store, utilize, transfer, and disclose your personal information (defined more explicitly in Section 2 below).

This Privacy Policy applies to all aspects of our Site as well as to information we may collect offline.

Our Site may contain links to or include websites or content that are managed and maintained by third parties, over which we do not have any control. These might include third-party websites, online properties, platforms, or social media, each of which adheres to the privacy policy and business protocols of the respective third party. Please note that Votyv is not liable for any breaches in security, privacy, or business practices of any third party. By using our site, you acknowledge and agree to this.

2. Information We Collect

We collect information from you directly, automatically as you navigate through our Site, and occasionally from third-party sources. Certain pieces of this information may be classified as "personal information" under various applicable laws. We regard information that uniquely identifies you as an individual (like your name, phone number, and email address), and additional data including IP addresses and cookie identifiers (as mandated by applicable laws) as personal information. If we merge what we deem to be non-personal data with personal information, we will handle the combined data as personal information under this Privacy Policy. In the rare cases where we handle sensitive personal information as defined by law, we do so in compliance with, and as allowed by the law. Please note, we may anonymize personal data to render it non-personal, for instance, by aggregating it or transforming it into a code, sometimes through a process known as "hashing." We will handle de-identified data as non-personal to the maximum extent permitted by law.

    Information You Provide
    Votyv may collect personal information from you when you:

    • i.

      Create an Account or Engaging with Our Site: At Votyv, we collect your name, email address and any other information you provide such as a phone number when you register, login, update, or add information to your account. Account creation requires a username and password. Additionally, we may gather certain details from any Social Media Platform account that you utilize for logging into or linking to your Votyv account, including your username, bio, and follower count. However, linking or logging in through such accounts is at your discretion. Payment information (like credit or debit card details) may be stored, but only if you choose to do so.

    • ii.

      Purchasing Through the Site: We gather the information you provide when you request a service or any other offering. This includes your name, email address, mobile phone contact number (yours or the recipient's), recipient's name, and the details provided as part of your request. We process payment information when you make a purchase and collect information about the recipients to the extent necessary to provide the Votyv offering.

      Participation in Sweepstakes, Contests, or Promotional Activities: We collect information you provide when you enter a Promotion via our Site. Each Promotion has its own terms and conditions or official rules which you should review.

      Customer Service Interaction: We collect information that you provide in the course of customer service provision.

      Providing Content to the Site: We gather information when you submit content, like a video, review, photo, email, text, social media post, or other communication (each, a "Submission"). Each Submission, whether made directly to our Site or through a Social Media Platform, is subject to the applicable Terms of Service.

Some of your information, such as your username, may be publicly displayed. Additionally, if other users of a Social Media Platform allow us access to their profiles, we may receive information about you.

      Using the Site as an Intercessor: In addition to the account creation information, we collect your name, email address, church address, phone number, social media usernames, content, and other offerings prepared by you when you become or act as an Intercessor. Payments to you are made through a third-party payment provider chosen by Votyv.

      Applying for a Job at Votyv: We collect the information you provide when applying for a job with us, such as your name, contact details, employment history, educational background, self-identifying information and other details you provide. Your use of a third-party tool or system for application is subject to the third party's privacy policy.

    Information from Third Parties
    We may gather information about you from other users, our affiliates, and third parties.
    Here are some examples:

    If you link your Votyv account to another service (like a third-party app or a social media platform), we may receive information from the other service about how you use that service.

    Advertisers, app developers, and other third parties may also share information with us. We may use this information, among other ways, to help tailor or measure the performance of ads. More details about our use of this kind of third-party data can be found in our Support Center.

    If another user syncs their contact list with our service, we may merge information from that user’s contact list with other information we have gathered about you.

3. Cookies and Tracking Technologies

    Cookies and Tracking
    Similar to many online services and mobile applications, we may employ cookies and other technologies, such as web beacons, web storage, and unique advertising identifiers, to gather information about your activity, browser, and device.     The methods that may be used to collect Usage Information include:

      Cookies and Local Storage: A cookie refers to a data file that's stored on a device when it is used to visit the Site or access our content in any other way. Some web browsers and specific browser add-ons, such as Adobe Flash, may provide additional local data storage mechanisms that operate similarly to cookies. Cookies, Flash cookies, and other local storage devices may serve various functions, such as recognizing your device when you return to our Site, remembering your login details, storing information associated with your navigation through our Site, or enabling specific features on our Site. The interpretation of "Do Not Track" in this scenario has yet to be universally agreed upon by industry participants. As with many websites and online services, Votyv does not modify its practices upon receiving a "Do Not Track" signal from a user's browser unless legally mandated.

4. How We Use Information

We may combine information that we have received from you with information from other sources to operate, tailor content, personalize, adjust, and improve our Site. We use your information:

    To facilitate your request for a service, product, or other offering, process your payment, dispatch your orders, transmit email communications, and manage the data you provide via our Site;

  • b.

    To maintain your account, assist with monetary transactions, ensure the smooth operation of the Site, and communicate with you concerning your account, our relationship, and your Site usage. This might involve verifying your details, soliciting your response to a survey, or checking the status of an order or request.     To build and manage a relationship with you as an Intercessor or a Votyv Partner;

  • d.

    To transmit promotional emails or text messages from Votyv, provided your settings permit or you've chosen to receive them (note: consent to receive automated marketing text messages is not a requisite for any purchase);

    To manage and administer a Promotion, should you choose to participate. We won't share your information with a third party for their marketing or promotional purposes unless you consent when opting to participate in the Promotion;

  • f.

    To provide you and others with customer support, aid in resolving issues, and assess and enhance our customer service and processes;

  • g.

    To utilize any Submission or Intercessor Content as stipulated in the applicable Terms of Service, which may involve public display of certain details, like your name, username, or location;

  • h.

    To assess your job application and, in association with the application, to satisfy legal reporting necessities, for internal business purposes (like evaluating and refining our recruitment processes), or to protect against employment-related claims;

  • i.

    To reach out to you regarding administrative matters, such as the relevant Terms of Service, or other issues;

  • j.

    To better comprehend your personal preferences and enable us to offer you enhanced and personalized communications and services;

  • k.

    To assemble aggregate data regarding Site traffic and interactions;

  • l.

    To customize the content and advertising we present to you or others, on our Site or elsewhere, and to examine trends and statistics;

Votyv also shares personal information as provided below in more detail. We do not share personal information with any third party to use for its own marketing or promotional purposes without your consent.

    Third Parties Providing Services on our Behalf
    We use third-party entities to carry out specific services on our behalf. These may include tasks such as hosting the Site, providing site usage analytics, order fulfillment, payment processing, dispatching emails or other forms of communication, offering marketing assistance and data optimization, overseeing Promotions, or carrying out other administrative tasks. To enable them to effectively deliver these services, we may share your information with these third parties.

  • b.

    Votyv Partners
    As an Intercessor, your information might be disclosed to the Votyv Partner who brought you onboard. This is done in connection with the services the Votyv Partner offers and for their business purposes, such as record-keeping and tax reporting.

  • c.

    Employment Applications
    If you apply for employment with Votyv or any of our subsidiaries or affiliates, we or our service providers might ask you to provide self-identifying details (such as veteran status, gender, ethnicity) in compliance with regulations enforced by the U.S. Equal Employment Opportunity Commission and other regulatory bodies. Providing such self-identifying information is optional. However, if you choose to provide this information, we and our service providers may submit it to the appropriate government or regulatory agencies to meet reporting requirements and use it to defend against employment-related complaints.

  • d.

    Sweepstakes, Contests, and Other Promotional Activities
    If you participate in a Promotion, your information may be shared with third parties or made public in relation to the management and execution of the Promotion. This could be, for example, to select a winner, deliver a prize, comply with relevant laws (such as publishing a list of winners), or as permitted by the applicable Promotion terms and conditions or official rules.

    When You Request That We Share Your Information
    We may share your information when you instruct us to do so. For instance, if you opt-in to receive a communication from a third party, or if you interact with a Social Media Platform or another third-party application or feature that results in your information being shared.

    Administrative Reasons, To Enforce and Protect Legal Rights

      As required by applicable law, we may disclose your personal information in response to legal regulations, court orders, or other official requests, such as disclosures related to criminal investigations, for instance those relating to fraudulent activities, violation of intellectual property rights, or any potentially illicit activities that could expose either Votyv, you, or any third party to legal consequences. Such disclosures may involve legal demands originating from a jurisdiction outside the United States, given we have a justified belief that compliance is necessitated by the laws, regulations, court orders, or other legal requests of that jurisdiction, impacts users in that jurisdiction, and aligns with globally accepted norms.

      Furthermore, we will reveal your personal information when it's necessary to uphold, exercise, establish, or protect our legal rights. For instance, we may scrutinize your account data to investigate accusations of cyber attacks or a breach of the relevant Terms of Service. We will pass on your personal information to our legal consultants, advisors, and law enforcement or other governmental authorities.

    Protecting Others
    Your personal information may be disclosed to third parties when we deem such disclosure necessary to safeguard the rights, property, or safety of others. Please note, even after opting out of marketing emails, we may still send you emails related to your account or your usage of the Site.     Third Party Advertising and Analytics Companies and Your Choices
    Votyv works with third-party network advertisers, ad agencies, and other advertising collaborators to present Votyv advertisements online. We utilize the information we've gathered about you to tailor ads directed at you and permit third parties to do the same. We also employ third-party analytics services to supply us with data concerning the usage of the Site and the effectiveness of our advertisements. These third parties may deploy their own tracking technologies on your device (like cookies and web beacons), and might also gather or gain access to information about you, including Usage Information. Both we and our third-party advertising and analytics services may gather personal information over time as you visit the Site or other online websites and services.

    Please be aware that declining to provide certain personal information may limit our ability to fulfill your requested Votyv product or service. For instance, without providing an email address, it will not be possible to create a Site account.

      If you possess a Site Account, you have the option to access, review, amend, or modify specific personal information gathered about you, as well as deactivate or delete your account, by utilizing the account services portal on votyv.com. Intercessors and clergy members can also deactivate their account by reaching out to their designated Votyv representative.

      Should you have any apprehensions regarding the utilization of your personal information, desire to access, rectify, or erase the personal information you have provided, kindly contact us through the details provided in the Contact Us section.

  • b.

    Retention Period
    Upon your request for the deletion of your personal information, we will undertake commercially reasonable measures to eliminate it from our active databases. However, we may retain original information in line with our established business practices to the extent allowed by applicable law. This retention may serve purposes such as dispute resolution, agreement enforcement, compliance with legal obligations, recordkeeping, backup, and document retention.

Votyv employs measures that are reasonably commercial in nature to safeguard the information provided to us. However, it's important to understand that no form of internet transmission or electronic storage method can guarantee absolute security, hence, any information you send to us or use on our Site is done at your own discretion and risk.     This notice is an addition to Votyv's privacy policy and is specifically applicable to residents of California, Virginia, and other United States jurisdictions that grant specific rights as outlined in this notice. The purpose of this Supplemental Privacy Notice is to provide disclosures and inform individuals of their rights concerning their personal information, as mandated by applicable laws. The terms used in this Supplemental Privacy Notice, including any capitalized terms, have the same definitions as provided in relevant state or local laws such as the California Privacy Rights Act and the Virginia Consumer Data Protection Act, along with their respective implementing regulations, unless otherwise specified.

The table at the end of this section outlines the various categories of Personal Information that Votyv has collected from our users and disclosed within the past 12 months. The specific Personal Information we collect and disclose about you will vary based on your interactions with our Site or other engagements with us. We retain this information for as long as it is necessary to provide our services. Please note that in addition to the categories mentioned below, we may collect, retain, and/or disclose other types of information. However, we will notify you and obtain your consent in accordance with applicable laws, where required, before doing so.

      Exercising Your Access, Deletion, Do-Not-Sell, Do-Not-Share, and Similar Rights

        Rights. You have certain rights that may include the following: the right to be informed about and access the specific pieces of Personal Information we have collected about you in the past 12 months, the right to correct or delete Personal Information we have collected about you, and the right to opt-out of the sharing or sale of Personal Information, subject to certain limitations.         Authorized Agent. If you are an agent submitting a request on behalf of a consumer, please ensure that the consumer completes, dates, and signs the Verification of Identity and Designation of Authorized Agent form available at this link. Send a copy of the completed form, along with a copy of a power of attorney, via email to support@votyv.com. In your email, please also specify the nature of the request. Please note that both the consumer's identity and your own will need to be independently verified before we can fulfill the request. We may also request direct confirmation from the consumer, ensuring they have granted you permission to submit the request. Please be aware that if we do not receive sufficient evidence of authorization, we may deny the request.

    • iii.

      Response Timing. We strive to promptly process your requests. For access or deletion requests, we aim to respond within 45 days from the date of receipt, and we will notify you if we require additional time to fulfill your request. For opt-out requests related to the sale or sharing of your personal information, we aim to respond within 15 business days from the date of receipt.

      Request to Know/Access or Request to Correct or Delete

        Making A Request. To inquire about the Personal Information we have collected about you over the past 12 months, or to request corrections or deletion of your information, you (or an authorized agent) can submit your request. Please provide the first and last name of the subject of the request, the email address associated with your interactions with Votyv, and confirm your jurisdiction of residency.         Verifying A Request. We will use the information you provide to verify your request and may ask for additional information if necessary. If we are unable to verify that the individual submitting the request is the same person for whom we have collected information (or someone authorized by that individual to act on their behalf), we will be unable to process the request. In the event that we decline your request, you have the option to appeal by contacting us at the email address or phone number mentioned above within a reasonable timeframe after the request is declined. Your appeal should include sufficient information for us to identify your original request and any additional information or reasons you would like us to consider during the appeal process.

        Request to Know/Access. To exercise your right to know/access the specific pieces of information we have collected about you, you (or an authorized agent) must provide us with sufficient information to verify your identity. As part of this verification process, we may require a signed declaration, under penalty of perjury, confirming that you are the subject of the request or an authorized agent. If we are unable to verify your identity as the subject of the request or an authorized agent, we will be unable to provide the requested information.

        Request to Delete. If you have a Site account, you can submit your request to delete through the account services portal on votyv.com. Additionally, you have the option to delete certain Personal Information you have provided to us through your online account, if applicable.

      Right to Opt-Out of Sharing or Sale of Personal Information. Votyv does not directly sell your Personal Information in exchange for monetary or other compensation. However, certain online advertising practices and analytics activities may involve sharing or sale under applicable law. To exercise your right to opt out of the sharing or sale of Personal Information with third parties, you can manage your preferences as explained in Section 7 above or click on the "My Privacy Choices" link located at the bottom of the votyv.com webpage you are currently visiting.
